Terms of Service

These Terms of Service ("Terms") govern your use of FFDB and related services operated by Forever Frameworks LLC ("Forever Frameworks", "we", "us", "our").

1. Agreement to Terms

By accessing or using FFDB, you agree to these Terms. If you do not agree, do not use the service.

These Terms apply to all users, including free users, paid users, and enterprise users, except to the extent a separate written agreement explicitly overrides a provision.

2. Eligibility

You must be at least 13 years old to use FFDB. If you use FFDB on behalf of an organization, you represent that you have authority to bind that organization.

3. Accounts and Security

  • You are responsible for account credentials and all activity under your account.
  • You must provide accurate information and keep it current.
  • You must promptly notify us of unauthorized account access.

4. Plans, Billing, and Refunds

  • FFDB includes a free plan with up to 2 projects.
  • Paid features and limits may be offered under separate pricing terms.
  • Fees are non-cancellable and non-refundable except as required by law.
  • Refunds are handled case-by-case at our sole discretion, unless required by law.
  • We may update plan features or pricing prospectively.

5. Payment Terms

  • Paid subscriptions renew automatically for successive billing periods unless canceled before renewal.
  • You authorize charges to your selected payment method for recurring fees, taxes, and any authorized overages.
  • Late, failed, or disputed payments may result in suspension or feature restrictions.

6. Acceptable Use

You may not use FFDB to:

  • Violate any law, regulation, or third-party right.
  • Disrupt service operation or security, including abuse, denial-of-service, malware distribution, credential stuffing, or unauthorized scanning.
  • Send spam, phishing, or deceptive communications.
  • Attempt unauthorized access to systems, accounts, or data.
  • Interfere with other customers or platform stability.

7. Suspension and Termination

We may suspend or terminate accounts at any time, with or without notice, if we believe use violates these Terms, poses risk, or threatens platform integrity, security, or legal compliance.

Upon termination, your right to use FFDB ends immediately. We may delete or de-identify remaining account data after a commercially reasonable period, subject to legal retention requirements.

8. Customer Data Ownership and Export

  • You retain ownership of your Customer Data.
  • You grant us a limited license to host, process, transmit, and back up Customer Data solely to provide and secure the service.
  • You may export/download your Customer Data at any time using available tools.

9. Intellectual Property

FFDB software, branding, design, and platform materials are owned by Forever Frameworks LLC and protected by law. Except for rights expressly granted, no license is transferred to you.

If you provide product feedback, suggestions, or ideas, you grant us a perpetual, irrevocable, worldwide, royalty-free license to use and incorporate that feedback without restriction or compensation.

10. Confidentiality

During use of FFDB, each party may receive non-public information from the other party. The receiving party will use such information only to perform obligations under these Terms and will protect it using reasonable care.

11. Enterprise and Isolated Environments

Enterprise, isolated, dedicated, maintenance, and support arrangements are available only under explicit written agreements that supersede these Terms where they conflict.

12. Service Disclaimer

FFDB is provided "as is" and "as available" without warranties of any kind, express or implied, including merchantability, fitness for a particular purpose, non-infringement, or uninterrupted availability. No uptime guarantee applies unless expressly stated in a separate written agreement.

13. Limitation of Liability

To the maximum extent permitted by law, Forever Frameworks LLC and its affiliates are not liable for indirect, incidental, special, consequential, exemplary, or punitive damages, or for lost profits, revenue, data, or goodwill. Our aggregate liability for claims related to FFDB is limited to the amount you paid us in the 12 months before the event giving rise to the claim (or USD $100 if you paid nothing).

The liability limits apply regardless of legal theory and even if a limited remedy fails of its essential purpose.

14. Indemnification

You agree to defend, indemnify, and hold harmless Forever Frameworks LLC and its officers, directors, employees, and agents from claims, liabilities, damages, and expenses arising from your use of FFDB, Customer Data, or violation of these Terms.

15. Dispute Limits and Class Action Waiver

To the maximum extent permitted by law, claims must be brought only in an individual capacity and not as a plaintiff or class member in any purported class, representative, collective, or private attorney general proceeding. You waive any right to jury trial to the extent permitted by law.

Any claim arising out of or related to FFDB or these Terms must be filed within one year after the claim arose, unless a longer period is required by law.

16. Governing Law and Venue

These Terms are governed by the laws of the State of Delaware, without regard to conflicts-of-law principles. Any dispute must be brought exclusively in state or federal courts located in Delaware, and each party consents to that jurisdiction and venue.

17. Export Controls and Sanctions

You represent that you are not located in, under the control of, or a national or resident of any country or entity subject to U.S. embargoes or sanctions, and you will not use FFDB in violation of export control or sanctions laws.

18. Force Majeure

We are not liable for delay or failure to perform caused by events beyond our reasonable control, including internet outages, utility failures, labor disputes, natural disasters, war, terrorism, civil unrest, pandemics, or governmental actions.

19. General Legal Terms

  • Entire Agreement: These Terms and any referenced policies are the complete agreement unless superseded by a separate written contract.
  • Severability: If any provision is unenforceable, the remainder remains in full force.
  • No Waiver: Failure to enforce a provision is not a waiver of future enforcement.
  • Assignment: You may not assign these Terms without our prior written consent; we may assign these Terms in connection with a merger, sale, or reorganization.
  • Survival: Sections that by nature should survive termination remain effective, including payment obligations, liability limits, indemnification, and dispute terms.

20. Changes to These Terms

We may update these Terms from time to time. Changes become effective when posted with an updated effective date. Continued use after changes are posted constitutes acceptance of the revised Terms.
